Joint Petition to Establish Child Custody, Visitation, and Child Support 
Fee: $450.00

 

A Joint Petition is used when both parents agree on custody, visitation, and child support terms and file together. The $450 flat fee includes preparation of the Cover Sheet, Joint Petition and Parenting Plan, Request for Submission, Proposed Order, notary services, required court copies, and filing with the court. Court filing fees are not included and are paid separately; in the Fourth Judicial District (Elko County), the current filing fee for a Joint Petition is approximately $275, though fees may vary by court. This service is limited to document preparation, notary, and filing and does not include legal advice or court representation.

Complaint to Establish Child Custody, Visitation, and Child Support 
Fee: $550.00
A Complaint is filed when one parent is requesting the court to establish custody, visitation, and child support without the other party’s agreement. The $550 flat fee includes preparation of the Cover Sheet, Complaint, Summons, Affidavit of Service, Request for Submission, Proposed Order, notary services, required court copies, and filing with the court. Court filing fees and service costs are not included and are paid separately; in the Fourth Judicial District (Elko County), the current filing fee for a custody complaint is approximately $275. If the opposing party cannot be located for service, an additional Motion for Alternative Service may be required at an additional cost. This service is limited to document preparation, notary, and filing and does not include legal advice or court representation.
Answer and Counterclaim to Complaint to Establish Child Custody, Visitation, and Child Support
Fee: $450.00

 

An Answer and Counterclaim is filed when you have been served with a custody complaint and wish to respond while also requesting your own relief from the court. The $450 flat fee includes preparation of the Answer, Counterclaim, Certificate of Mailing, Proof of Mailing, notary services, required court copies, and filing with the court. Court filing fees are not included and are paid separately; in the Fourth Judicial District (Elko County), the current filing fee for an Answer and Counterclaim is approximately $198, though fees may vary by court. This service is limited to document preparation and filing and does not include legal advice or court representation.

Motion to Modify Child Custody, Visitation, and Child Support 
Fee: $500.00
This Motion is used to request changes to existing custody, visitation, or child support orders due to a change in circumstances. The $500 flat fee includes preparation of the Motion, Declaration in Support of Motion, Affidavit of Service, Reply to Opposition, Request for a Hearing, Proposed Order, notary services, required court copies, and filing with the court. Court filing fees are not included and are paid separately; motions filed after a complaint typically require a $25 filing fee, while motions filed after a joint petition generally require a $129 filing fee, depending on the case posture. This service is limited to document preparation, notary, and filing and does not include legal advice or court representation.
Stipulation and Agreement to Modify Child Custody, Visitation, and Child Support 
Fee: $350.00

A Stipulation and Agreement is used when both parties agree to modify existing custody, visitation, or child support orders without contested litigation. The $350 flat fee includes preparation of the Stipulation and Agreement, Request for Submission, Proposed Order, notary services, required court copies, and filing with the court. Court filing fees are not included and are paid separately; in the Fourth Judicial District (Elko County), the filing fee is typically $25 or $129, depending on whether the case originated from a complaint or a joint petition. This service is limited to document preparation, notary, and filing and does not include legal advice or court representation.
